ORDER

This writ petition has been filed challenging the impugned order dated 16.11.2025 passed by the third respondent rejecting the petitioner's application seeking for issuance of patta in her favour for the property morefully described in the prayer to this writ petition. The petitioner has challenged the impugned order on the ground that it violates the principles of natural justice and that it is a non-speaking order.

2. According to the petitioner, without conducting any proper enquiry, by a non-speaking order, the impugned order has been passed by the third respondent rejecting the petitioner's application seeking for issuance of patta in her name for the subject property.

3. Mr.C.Jayaprakash, learned Government Advocate, accepts notice on behalf of the respondents 1 to 3. Since no adverse orders are passed against the fourth respondent in this writ petition, notice to the fourth respondent is dispensed with.

4. No prejudice will be caused to the third respondent if the impugned order, which is a non-speaking order and has been passed without conducting

any enquiry, is quashed and remanded back to the first respondent for fresh consideration on merits and in accordance with law. Accordingly, this writ petition is disposed of in the following manner:- (a) The impugned order dated 16.11.2025 passed by the third respondent is quashed and the matter is remanded back to the first respondent for fresh consideration on merits and in accordance with law, on the petitioner's application seeking for issuance of patta in her name for the subject property.

(b) The third respondent shall pass final orders, after giving due consideration to the supporting documents filed by the petitioner as well as after hearing the objections of the fourth respondent, and also by adhering to the principles of natural justice, within a period of 12 weeks from the date of receipt of a copy of this order. This Court is not expressing any opinion on the merits of the petitioner's application. No Costs.
