Crl.OP.Nos.1827 and 1843 of 2020 P.RAJAMANICKAM.J., In view of the letter submitted by the learned Principal Sessions Judge, Salem dated 15.10.2020, this matter is listed today (23.12.2020).
2. This Court by the Order dated 19.05.2020 had allowed Crl.OP.No.33286 of 2019 with the following directions: " In the result, Crl.OP.No.33286 of 2019 is allowed. The case in SC.No.116 of 2016 is withdrawn from the file of the Principal District and Sessions Judge, Namakkal and transferred to the Principal District and Sessions Judge, Salem, for disposal of the same in accordance with law. The accused are directed to co-operate for early disposal of the said case without seeking unnecessary adjournments".
3. The learned Principal Sessions Judge, Salem by the letter dated 15.10.2020 has stated that in pursuance of the order passed by this Court in Crl.OP.No.33286 of 2019, the case in SC.No.116 of 2016 was transferred from the Principal Sessions Court, Namakkal District to the 1/3
Principal District and Sessions Judge, Salem on 06.10.2020 and renumbered as SC.No.45 of 2020. He further stated that his native place comes within the jurisdiction of Erumapatty Police Station, Namakkal District and the above case has been registered in the Erumapatty Police Station and hence, he requests to transfer the said case to some other court.
4. Considering the aforesaid submissions of the learned Principal District and Sessions Judge, Salem, the Principal District and Sessions Judge, Salem is directed to transfer the case in SC.No.45 of 2020 (formerly SC.No.116 of 2016 on the file of the Principal Sessions Court, Namakkal) to I Additional District and Sessions Judge, Salem, for disposal of the same in accordance with law. The accused are directed to co-operate for early disposal of the said case without seeking unnecessary adjournments.
