This petition has been filed by the petitioner / appellant seeking to condone the delay of 89 days in filing the above T.C. (SR) No. 45255 of 2006. 2.Despite the service of notice and the name of the respondent having been printed in the cause list, there is no representation on their behalf. 3.Heard Mr. V.Prasanth Kiran, learned standing counsel appearing for the petitioner, who submitted that the issue involved herein is covered by the order of this court dated 01.07.2011 in TC (R) No.842/2006 etc. batch, wherein, it was held that the dyes and chemicals used in the execution of works contract would attract levy of tax and hence, the delay may be condoned and the tax case may be listed for passing appropriate orders.

4.Considering the reasons stated in the affidavit filed in support of this petition and also taking note of the submissions made by the learned counsel for the petitioner, the delay is condoned and this petition is ordered accordingly.
