Respondent PRAYER: Second Appeal is filed under Section 100 of C.P.C against the judgment and decree of first appellate Court that is the Additional Subordinate Judge Court at Chenglepet dated 28.08.2009 passed in AS.No.65/2007 by confirming the Judgment and decree of the Trial Court that is the District Munsif-cumJudicial Magistrate Court at Thirukalukundram dated 31.07.2007 passed in O.S.No.68 of 2002.

J U D G M E N T

(The case has been heard through video conference) There is no representation for the appellant. When the matter was listed in the earlier occasion, the learned counsel for the appellant stated that settlement talk has been going on between the parties and sought time for reporting settlement. However the learned counsel for the respondent reports that there is no settlement talk and in fact the premises which is the subject matter of dispute was given to the appellant for the union activity, later in view of the dilapidated condition to demolish the same the appellant was asked to vacate the premises. The appellant has given alternate site to the union office.

2. In the light of the above facts and in the light of non appearance of the appellant after taking adjournment for reporting settlement, nothing survives in this Second Appeal and the same is dismissed. Consequently, connected miscellaneous petition is also closed. No costs.
