Mr.S.Balaji Government Advocate(criminal Side) Order The petitioner seeks modification of the condition imposed by this Court while suspending the sentence on 25.10.2025. This Court had inter alia passed the following condition;

"(a) the petitioner/accused is ordered to be released on bail, on executing a bond for a sum of Rs.25,000/- (Rupees Twenty Five Thousand only) with two sureties, in which one surety shall be a blood related surety, each for a like sum to the satisfaction of the learned Special Court for Exclusive Trial of cases under POCSO Act, Cuddalore"

2.The learned counsel for the petitioner would submit that though the order was passed on 25.10.2025, the petitioner is unable to execute the surety as the learned Sub Judge is insisting on property document to prove the worth of the petitioner.

3.This Court is of the view that the said condition is onerous.

4.Therefore, the learned Sub Judge may not insist on any property document and may permit the petitioner to comply with the condition imposed by this Court and obtain a bond for a sum of Rs.25,000/- from him, with two sureties, of which, one surety shall be his son. 5.With the above modification, the petition is ordered. 26-02-2026 Index: Yes/No Speaking/Non-speaking order TSG To 1.The Inspector of Police, Cuddalore, AWPS Neyveli Police Station, Cuddalore District.
