This Criminal Original Petition is filed under Section 483 of BNSS to enlarge the petitioner on bail concerned in S.C.No.102 of 2020, XXI Additional Sessions Court, at Allikulam, Chennai in Crime NO.509 of 2011, D1 Triplicane Police Station, Chennai.

ORDER

The petitioner, who was arrested on 11.10.2025 for the alleged offence under Sections 147, 148, 341, 294(b), 323, 307, 506(ii) and 302 read with Section 34 of IPC with Crime No.509 of 2011 on the file of the respondent police, seeks bail.

2. The learned counsel for the petitioner submitted that this is the second bail application filed by the petitioner. He further submitted that the petitioner was released on bail by order dated 24.10.2024 passed by this Court in Crl.O.P.No.26409 of 2024 and thereafter NBW was issued against the petitioner on 18.12.2024 for his non appearance and NBW was executed and the petitioner was remanded to judicial custody on 11.10.2025. He further submitted that the petitioner has been in custody from 11.10.2025. Hence, he prays fro grant of bail to the petitioner.

3. The learned Government Advocate (Crl.Side) appearing for respondent police submitted that the petitioner absconded for more than nine months and after considerable efforts, he was secured. It is further submitted that petitioner has three previous cases pending against him, of which one is a murder case and the other two are NDPS cases. Hence, he vehemently opposed the grant of bail to the petitioner.

4. Considering the bad antecedents of the petitioner and that he absconded for more than nine months, I am not inclined to grant bail to the petitioner.

5. Accordingly, this Criminal Original Petition stands dismissed. 09.02.2026 jai
