ORDER

The petitioner, who was arrested and remanded to judicial custody on 12.12.2025, for the offences punishable under Sections 304(2) of BNS in Crime No.752 of 2025, registered on the file of the respondent police, seeks bail.

2.The case of the prosecution is that the petitioner joined hands with other accused and involved in the act of chain snatching . It is alleged that while tracing the petitioner was identified and he was arrested . Hence, this case.

3.The learned counsel appearing for the petitioner submitted that in the F.I.R it was categorically stated that some unknown persons have snatched the gold chain of the victim and the petitioner is in judicial custody from 12.12.2025. He further submitted that the petitioner is ready to abide by any conditions that may be imposed by this Court and sought for bail to the petitioner.

4.The learned Government Advocate (Criminal Side) appearing for the respondent while opposing the bail to the petitioner, reiterated the prosecution case and submitted that the petitioner joined hands with other accused committed a series of offence of chain snatching and there are eight previous cases pending against the petitioner. He further submitted that the stolen property is recovered. Hence, opposed to grant bail to the petitioner. 2/4

5.Considering the facts, gravity of offence and the fact though the stolen property is recovered, there are eight previous cases pending against the petitioner, and if the petitioner is released on bail he will attempt to tamper the evidence, this Court is not inclined to grant bail to the petitioner.
