Thiruchengodu Revenue Division, to pass orders on the writ petitioner's Appeal Petition dated 12.10.2017 filed against the order passed by the 2nd respondent/ Tahsildar in Na.Ka.No. 3130/ A2/ 2017 dated 24.08.2017 in respect of lands comprised in Survey no. 19/4 Sub divided No. 19/4B1 measuring an extent of 0.68 cents situated at Kadachanallur Village, Tiruchengodu Taluk, Namakkal district within the time fixed by this court.

ORDER

This writ petition has been filed seeking for a limited relief. The petitioner seeks for early disposal of their appeal dated 12.10.2017 pending on the file of the first respondent. The petitioner has filed the said appeal aggrieved by the order passed by the second respondent dated 24.08.2017.

2. Mr.C.Jayaprakash, learned Government Advocate, accepts notice on behalf of the respondents 1 and 2. Since no adverse orders are passed against the third respondent, notice to the third respondent in this writ petition is dispensed with.

3. The learned counsel for the petitioner would submit that earlier another Revenue Divisional Officer had heard the matter, and therefore, the present Revenue Divisional Officer will have to rehear the matter and pass final orders. The said statement made by the learned counsel for the petitioner is recorded.

4. No prejudice will be caused to the present Revenue Divisional Officer, if a direction is issued to the said authority to rehear the matter afresh and pass final orders within a time frame to be fixed by this Court. Accordingly, this writ petition is disposed of by directing the first respondent to dispose of the petitioner's appeal dated 12.10.2017 on merits and in accordance with law, after hearing the objections of the third respondent, and also by adhering to the principles of natural justice, within a period of 12 weeks from the date of receipt of a copy of this order.
