Prayer:- Writ petition filed under Article 226 of the Constitution of India praying to issue a Writ of Mandamus, directing the 1st respondent herein to appoint the petitioner on compassionate ground for the suitable post in the 2nd respondent based on the representation given by the petitioner dated 24.10.2019 within a stipulated time.

This writ petition has been filed for the issue of writ of Mandamus, directing the 1st respondent to consider the appointment of the petitioner on compassionate ground in a suitable post in the 2nd respondent Taluk office. 2.

The case of the petitioner is that his father was working as a Village Assistant in the 2nd respondent Taluk office. He died while he was in service on 11.12.2007. The further case of the petitioner is that he left behind the petitioner, his mother and two sisters as legal heirs. The father of the petitioner had married another women and there was one son and daughter out of the said relationship. 3.

After the death of the father, the son and the 2nd wife applied for compassionate appointment and the same was rejected. The petitioner made an application on 13.03.2019 to https://hcservices.ecourts.gov.in/hcservices/

the 1st respondent seeking for compassionate appointment along with the legal heirship certificate. The 1st respondent had sent a letter dated 14.03.2019 directing the petitioner to submit the representation in a proper format. Thereafter, the petitioner made another representation on 24.10.2019 making a similar request. Since the same was not considered, the present writ petition has been filed before this Court. 4.

Heard the learned counsel for the petitioner and the learned counsel for the respondents.

Taking into consideration the facts and circumstances of the case and also the limited relief that has been sought for in this writ petition, there shall be a direction to the 1st respondent to consider the application made by the petitioner (if it has already been submitted in a proper format) along with the representation made by the petitioner on 24.10.2019 and pass appropriate orders strictly in accordance with law, within a period of eight weeks from the date of receipt of a copy of this order. The petitioner is directed to make a fresh representation to the 1st respondent along with copy of this order. It is made clear that if the petitioner has not already submitted the application in the proper format, the petitioner shall submit an application in an appropriate format to the 1st respondent along with the fresh representation. No Costs.
