Prayer: Contempt Petition has been filed under Section 11 of Contempt of Courts Act, to punish the 1st to 3rd respondents herein for their wilful and deliberate disobedience of the orders of this Hon'ble Court passed in Crl.M.P.No.20112 of 2022 in Crl.O.P.No.15821 of 2022 dated 10.04.2023 in accordance with the Contempt of Courts Act.

O R D E R
This Contempt Petition is filed alleging that the order passed by this Court in Crl.M.P.Nos.20112 of 2022 & 2616 of 2023 on 10.04.2023 not been complied by the respondents. The operative portion of the order which has alleged to have been disobeyed reads as below:- "23.Considering the vexatious and complicated issues involved in this case, this Court deems it fit that this case should be further investigated by a Special Team to be formed by the Additional Director General of Police, CBCID. The Additional Director General of Police, CBCID is directed to constitute a special team consisting of Deputy Superintendent of Police, Inspector of Police, Sub Inspector of Police and necessary other police officials for the purpose of further investigation of this 2/6
case. After the completion of the investigation, the investigation officer should file additional/supplementary final report before the concerned learned Judicial Magistrate for further necessary action. As already indicated, out of the three sale deeds, two must be forged and fabricated sale deeds. Out of the two Sowmiya, both may be fictitious/dubious persons or one of them may be fictitious/dubious person. Whatsoever may be the case, necessary legal action must be taken against the persons who had forged and fabricated the sale deed and impersonated as Sowmiya by adding them as accused in this case.
24.Post the matter after one month for reporting compliance."
2. The Learned Government Advocate (Crl.Side) appearing for the respondents submitted that initially the matter was investigated by Inspector of Police, Central Crime Branch. When this order was passed by the Court, the matter was under investigation by Central Crime Branch. After impleading Sowmiya as per the direction of this Court, certain new facts come to the notice of the Investigating Officer and matter been transferred to C.B.C.I.D by proceedings dated 09.05.2023, as per the direction passed by this Court vide order in Crl.M.P.Nos.20112 of 2022 & 2616 of 2023 dated 10.04.2023. 3/6
3. The voluminous material collected in the course of investigation had caused difficulty in completing the investigation and to file final report, particularly, allegation of forgery and impersonation need to be probed. Hence, some more time is granted to file final report.
4. The Learned Government Advocate (Crl.Side) for the respondents submits that there is no intention or wilful disobedience of the Court order in filing the final report. Due to administrative difficulty in collecting the material from the experts, delay has caused. Further, the Learned Government Advocate (Crl.Side) for the respondent states that he undertakes to file final report within a period of two months since substantial investigation has been completed.
