ORDER

This criminal original petition has been filed by the petitioner/de facto complainant seeking expeditious disposal of C.C.No.177/2022 pending on the file of the Judicial Magistrate Court, Rasipuram, arising out of the complaint filed under Sections 138 and 142 of the Negotiable Instruments Act, 1881 as amended by the Act 20.01.2008 under Sections 190 (1) (A) read with 200 of

Cr.P.C.

2. The learned counsel for the petitioner submitted that the case is of the year of 2022 and as per Section 143(3) of the Negotiable Instruments Act, 1881, the trial court should take every endeavour to conclude the trial within a period of six months from the date of filing of the complaint. Therefore, the learned counsel appearing for the petitioner prays for the indulgence of this Court to direct early disposal of the case.

3. Heard the learned counsel for the petitioner and perused the materials available on record.

4. This Court's attention has been drawn to Section 143 (3) of NI Act, as per which the trial court is bound to conduct trial as expeditiously as possible. Section 143(3) of NI Act, is as below:- "Every trial under this section shall be conducted as expeditiously as possible and an endeavour shall be made to conclude the trial within six months from the date of filing of the complaint."

5. Considering the facts and circumstances of this case and also considering that the case is of the year 2022 and the same has been pending for the past four years, this Court directs the learned Judicial Magistrate, Rasipuram, to dispose of the case in C.C.No.177 of 2022, as expeditiously as possible, preferably within a period of six months from the date of receipt of a copy of this order.

6. With the above direction, this criminal original petition stands disposed of.
