ORDER

The petitioner, who was arrested and remanded to judicial custody on 07.12.2025, for the offences punishable under Sections 329(4), 296(b), 115(2),76,351(2) of BNS in Crime No.326 of 2025, registered on the file of the respondent police, seeks bail.

2.The case of the prosecution is that the petitioner trespassed into the house of the defacto complainant and attempted to commit sexually assault on her and abused her and attacked her indiscriminately and also threatened with dire consequences. It is alleged that hearing the alarming noise of the victim neighbours residing in the same locality rescued her. Hence, this case.

3.The learned counsel appearing for the petitioner submitted that due to previous enmity a false case has been registered against the petitioner and he is in judicial custody from 07.12.2025. He further submitted that the petitioner is ready to abide by any conditions that may be imposed by this Court and sought for bail to the petitioner.

4.The learned Government Advocate (Criminal Side) appearing for the respondent while opposing the bail to the petitioner, reiterated the prosecution case and submitted that the petitioner is having nine previous cases Hence, opposed to grant bail to the petitioner. 2/4

5.Considering the facts, gravity of offence and there are nine previous cases pending against the petitioner and if the petitioner is released on bail he will attempt to tamper the evidence, this Court is not inclined to grant bail to the petitioner.
