Writ Petition is filed under Article 226 of Constitution of India praying to issue Writ of Certiorarified Mandamus calling for the records of the second respondent proceedings in Na.Ka.No.A1-6388-2016 dated 20.02.2023 and to quash the same and consequently direct the first and 1/4

second respondents to provide the employment to the petitioner under the compassionate appointment.

This writ petition has been filed challenging the order passed by the second respondent dated 20.02.2023 thereby rejected the request made by the petitioner seeking appointment on compassionate ground.

The petitioner's father had joined as Village Administrative Officer in the year 1984. While he was in service, he died on 04.08.1995 leaving behind the petitioner's mother, the petitioner and another brother. However, at the time of his demise, the petitioner and his brother were minors. The petitioner's mother submitted representation on 05.08.1996. She was not in position to accept the appointment on compassionate ground. However, she reserved her right to seek employment for her legal heirs when they attain majority.

It is seen that now the petitioner is aged about 38 years. After period of 27 years from the date of the death of his father, the request made by the petitioner cannot be considered. The purpose of compassionate appointment would not serve if the petitioner is given employment on compassionate ground. Therefore, the request made by the petitioner was rightly rejected. Further, the rejection order was passed before one year and the same is challenged only now. Therefore, this writ petition is devoid of merits and liable to be dismissed. 4.

Accordingly, this writ petition is dismissed. Consequently, connected miscellaneous petition is closed. There shall be no order as to costs.
