J U D G M E N T

(Order of the Court was made by S.M.SUBRAMANIAM, J.) The Writ Appeal has been instituted challenging the writ order dated 12.04.2019 made in W.P.No.3020 of 2019.

2. The writ petitioner is the appellant. The appellant filed a Writ of Declaration to declare the content "Diploma in Siddha Medicine is not recognised to practice as Siddha Doctor" in impugned order bearing D.Ed.Sl.No.0769 issued by the 1st respondent is null and void and consequently permit the petitioner to practice as a Siddha Medical Practitioner.

3. The very relief sought for in the Writ Petition is not maintainable, since one year Diploma Course cannot be equated with the regular Medical Course of Siddha, which is a five years course. The very comparison set out by the appellant is untenable. A Diploma holder cannot be allowed to practice as a Doctor. Thus, the relief, as such, sought for is not maintainable and the writ Court has rightly dismissed the Writ Petition. That apart, the writ Court relied upon the judgment of the Division Bench in W.P.No.28814 of 2017 dated 13.10.2008, which is a public interest litigation. The appellant has not established even a semblance of legal right for the purpose of entertaining the Writ Appeal.
