Respondents Prayer:- Writ Petition filed under Article 226 of the Constitution of India praying for issuance of a Writ of mandamus directing the 2nd and 3rd respondents to dispose of the petitioners representation dated 28.10.2016 by considering the petitioner to the post of Village Administrative Officer by way of promotion in light of the G.O.No.570 Revenue Department [Service 8[1]] dated 26.12.2014 issued by the 1st respondent and G.O.No.254, Revenue Department [Service 8[1]] dated 09.07.2015 issued by the 1s respondent within a time frame to be fixed by this Court.

ORDER

By consent, the writ petition is taken up for final disposal. Mr.K.Dhananjayan, learned Special Government Pleader accepts notice on behalf of the respondents.

2 The petitioner would state that he has completed SSLC in the year 1984 and in the year 1986, he completed training at Government Industrial Training Institute, Mettur Dam and passed the prescribed test in the trade of Electricians and also attended apprenticeship training at Texmo Industries between 20.06.1987 and 20.06.1988 and a Training Certificate was also issued by the Assistant Director of Training [Apprentices]. The petitioner further claims and he has also passed the prescribed trade test conducted by the National Council for Training in Vocational Trades and he belongs to Kuravan Schedule Caste community. It is further stated by the petitioner that he was appointed as Village Assistant on 01.09.

1992 and ever since the date of his appointment, he is performing his duties honestly and sincerely and despite the fact that he has put in 24 years in the post of Village Assistant, he has not been given promotion and in this regard, very many representations have been submitted. The petitioner would further state that as per G.O.ms.No.570, Revenue Department, dated 26.12.2014, 20% of the vacancies to the post of Village Administrative Officer, to be filled up by way of promotion and since the petitioner had fulfilled necessary criteria, his claim should have been positively considered and since the grievance expressed by the petitioner has not been addressed, he came forward to file the present writ petition.

3 Heard the submissions of the learned counsel for the petitioner and Mr.K.Dhananjayan, learned Special Government Pleader appearing for the respondents and also perused the materials placed before this Court, in the form of typed set of documents.

4 Though the petitioner has prayed for a larger relief, this Court, in the light of the facts and circumstances and without going into the merits of the claim projected by the petitioner, either in his representation or in this writ petition, directs the 3rd respondent to consider and dispose of the petitioner's representation dated 28.10.2016 on merits and in accordance with law and pass orders within a period of eight weeks from the date of receipt of a copy of this order and communicate the decision taken, to the petitioner.

The writ petition stands disposed of with the above direction. No costs.
