THE HONOURABLE MR.JUSTICE R.SUBRAMANIAN Contempt Petition No.605 of 2019 S.Kesava Viswanathan ... Petitioner

Versus

R.Sangeetha ... Respondent PRAYER: Petition filed under Section 11 of the Contempt of Courts Act, 1971 to punish the respondent herein for willfully disobeying the order made in Application No.6949 of 2009 dated 16.04.2010 and handover the custody of the minor Eshitha Parthi Shri to the petitioner.

For Petitioner : Mr.R.Ramanlaal For Respondent : M/s. Kingsley Soloman

O R D E R

This petition seeks to punish the respondent for willful disobedience of the order passed in Application Nos. 6948 and 6949 of 2009 dated 16.04.2010, granting visitation rights to the father. Admittedly, the father is residing in United States and he was given visitation https://hcservices.ecourts.gov.in/hcservices/ rights for two days in a year, between 10 am and 5 pm.

Initially the visitation went of well, when the child was very young. Now the child is 15 years old and she is studying in 10th standard. I had interacted with the child. Despite my persuasion, she expressed her strong disinclination to even meet the father.

2. My interaction with the child leaves no doubt that the child will be immensely inconvenienced, if she is forced to meet the father or if the father is allowed visitation rights. Hence I do not think that any purpose will be served by keeping this application pending.

3. Hence, the Contempt Petition is closed as no orders are necessary. No costs.
