Respondents Prayer: Petition filed under Article 226 of the Constitution of India seeking issuance of a writ of mandamus directing respondents 1 to 5 to consider the representation dated 4.1.2024 of the petitioner and to take action against the encroachment on the cart track in S.No.611/1A of Karaipudur Village, Palladam Taluk, Tirupur District. ORDER

(Order of the court was made by the Hon'ble Chief Justice) We have heard Mr.T.N.Rajagopalan, learned counsel for Mr.S.Kamalesh Kannan, learned counsel for the petitioner; Mr.A.Edwin Prabakar, learned State Government Pleader for respondents 1 to 4; and, Mr.L.Jaivenkatesh, learned counsel for

respondent No.5.

2. A prayer is made seeking directions to respondents 1 to 5 to consider the representation of the petitioner and take action against the encroachment on the cart track in Survey No.611/1A of Karaipudur Village, Palladam Taluk, Tirupur District.

3. Learned State Government Pleader submits that the petitioner can approach the Committee constituted under G.O.(Ms) No.64, Revenue and Disaster Management Department, Land Disposal Wing, dated 08.02.2022.

4. In view of that, the petitioner may approach the Committee constituted under G.O.(Ms) No.64, Revenue and Disaster Management Department, Land Disposal Wing, dated 08.02.2022. If such application is made, the Committee shall consider the said application on its own merits and in accordance with law, after adhering to the principles of natural justice, preferably within four months from the date the application is made by the petitioner.

The writ petition is disposed of accordingly. There shall be no order as to costs. Consequently, W.M.P.No.1825 of 2024 is closed. (S.V.G., CJ.) (D.B.C., J.) 30.01.2024 Index :
