ORDER

Tracing title from sale deed dated 28.01.1977 bearing Document No.67 of 1977 and sale deed dated 05.06.1977 bearing Document No.1432 of 1977, the petitioner presented a partition deed for registration. The request for registration was declined by citing the decree in O.S.No.85 of 2010.

2. Mr.U.Baranidharan, learned Special Government Pleader, accepts notice for all the respondents. By referring to the decree, he points out that lands in Survey Nos.252/11 and 252/14 are covered by the decree. Therefore, he submits that the refusal is fully justified.

3. In response, learned counsel for the petitioner submits that the partition deed also covers items 3 and 4 pertaining to Survey Nos.252/7 and 252/8, which

are not dealt with in the decree. He seeks leave to execute and present a document pertaining thereto.

4. Out of the items of property forming the subject of the partition deed, it appears that two items, namely land in Survey Nos.252/11 and 252/14 are covered by the decree. Therefore, there is no reason to interfere with the impugned order. By leaving it open to the petitioner to execute and present a document pertaining to the third and fourth items mentioned in the partition deed, this writ petition is disposed of.
