Respondent PRAYER : Appeal filed under Clause 15 of the Letters Patent to set aside the order passed by the learned Single Judge in W.P.No.48697 of 2025, dated 15.12.2025.

JUDGMENT

(Delivered by the Hon'ble Chief Justice) Heard learned counsel for the appellant.

2. This intra-Court appeal filed under Clause 15 of the Letters Patent assails the order dated 15.12.2025 passed in W.P.No.48697 of 2025, whereby the learned Single Judge disposed of the writ petition with liberty to file an appeal before the Electricity Ombudsman within 30 days. Qua the limitation aspect, the learned Single Judge observed that since the appellant was bonafide pursuing the writ petition, if the appeal is presented within 30 days from the date of passing of the order, the same shall be entertained by the Ombudsman and decided on its own merits and in accordance with law.

3. Learned counsel for the appellant submitted that the Ombudsman is not the competent authority to decide the issue and the fourth respondent, namely the Executive Engineer, TNPDCL, is the appellate authority and the said authority ought to have been directed to consider the appeal.

4. Learned counsel for the appellant further submitted that the appellant has filed the appeal before the Ombudsman thereby complying with the order passed by the learned Single Judge and that the Ombudsman has also passed orders on the appeal preferred by the

appellant.

5. Since the appellant has already availed the remedy of appeal as directed by the learned Single Judge, we do not find any merit to entertain the present writ appeal. Accordingly, the writ appeal is dismissed. However, the appellant would be at liberty to file appropriate proceedings, in accordance with law, if so advised. There shall be no order as to costs. Consequently, connected miscellaneous petition is closed.
