ORDER

This Criminal Original Petition has been filed seeking a direction to the respondent police to file a final report in Crime No.88/2017 pending on his file.

2. The case of the petitioner is that as against one Arun and his mother, she has lodged a complaint and the same was registered as FIR in Crime No.88 of 2017 dated 05.02.2017 on the file of the respondent police for the offences punishable under Sections 341, 323, 379 and 506(i) IPC and Section 4 of the Tamil Nadu Prohibition of Harassment of Woman Act, 2002. Thereafter, no steps have been taken by the respondent police to conduct investigation and file a final report as per law. Hence, this petition.

3. Today, when the matter was taken up for consideration, learned Additional Public Prosecutor, on instructions, submitted that as against the husband of the petitioner herein, a counter complaint has been lodged on the same day for the very same occurrence and the same was also registered as FIR in Crime No.89 of 2017 for the offences https://hcservices.ecourts.gov.in/hcservices/

punishable under Sections 294(b), 323 and 506(i) IPC and Section 4 of the Tamil Nadu Prohibition of Harassment of Woman Act, 2002.

4. Considering the fact that there are case and counter case pending against each other, this Court directs the respondent police to conduct enquiry in both the cases in Crime Nos.88 and 89 of 2017 dated 05.02.2017 pending on his file by calling upon all the parties concerned and file a final report, as expeditiously as possible.

5. Accordingly, the Criminal Original Petition is ordered.
