J U D G M E N T

Second Appeal has been filed against the judgment and decree passed in A.S.No.39 of 2007, dated 30.11.2007, on the file of the Sub Court, Udhagamandalam, in reversing the judgment and decree passed in 1/3

O.S.No.233 of 2004, dated 19.01.2007, on the file of the District Munsif, Udhagamandalm.

2.When the matter was called on 06.06.2024, the learned counsel for the appellant was not ready. Hence, once again the matter was ordered to be listed on 27.06.2024 and thereafter, on 27.06.2024, when the matter was called there was no representation for the appellant and the matter was listed to-day i.e., on 11.07.2024.

3. Even today, when the matter is called, there is no representation on behalf of the appellant. Hence, this Second Appeal is dismissed for 'non prosecution'. No costs. Consequently, connected miscellaneous petitions, if any, are also closed.
