The learned counsel appearing for the appellant has filed a memo reporting no instruction, since he was a co-counsel along with the learned Senior Counsel Mr.K.Yamunan, who lost his breath long back. This Court requested the learned counsel appearing for the appellant to ascertain whether anything survives in this matter and adjourned the case today i.e 25.01.2019. The learned counsel appearing for the respondent is not in a position to assist the Court regarding the query raised. Hence, this Second Appeal is dismissed. No order as to costs.
