Prayer: Writ Petition filed under Article 226 of the Constitution of India seeking a Writ of Certiorarified Mandamus calling for the records of the second respondent with No.Nil dated Nil regarding the list of Tsunami affected villagers at Chinna Kalapet hamlet and the allotment of houses to the respondents 3 to 11 and to quash the same and consequently to direct the respondents 1 and 2 to allot and handover house No.74 to the petitioner on the basis of the earlier allotment in which the petitioner was granted Plot No.74.

This writ petition has been filed challenging the list of Tsunami affected villagers at Chinna Kalapet hamlet and the allotment of houses to the respondents 3 to 11 and further seeks a direction to the respondents 1 and 2 to allot and handover house No.74 to the petitioner on the basis of the earlier allotment in which the petitioner was granted Plot No.74.

2. The learned counsel appearing for the petitioner would submit that the petitioner has died and the Legal Representatives of the petitioner have 2/4

applied for Legal Heir Certificate and therefore seeks liberty to the LRs of the petitioner to file a fresh writ petition.

3. Such view of the matter, this writ petition is dismissed, however, with liberty to the LRs of the petitioner to file fresh writ petition as per law. Consequently, the connected miscellaneous petitions are closed. No costs. 26.09.2022 kk To
