C.M.P.No.1236 of 2022 in C.M.A.SR.No.7796 of 2022 P.T.ASHA, J., This petition is filed to condone the delay of 1617 days in filing the Civil Miscellaneous Appeal against the judgment and decree dated 16.06.2015 made in M.C.O.P.No.1731 of 2012 on the file of the Motor Accident Claims Tribunal (Special Sub Court - II) Salem.
2. Heard the learned counsel for the petitioner/appellant and Mr.D.Nithin, who takes notice on behalf of the respondent.
3. The learned counsel for the respondent has no objection for this petition being allowed.
4. Being satisfied with the reasons stated in the affidavit filed in support of the petition, this petition is allowed and the delay of 1617 days in filing the C.M.A.SR.No.7796 of 2022 is condoned.
5.It is made clear that the claimant will not be entitled for any interest for the delay period of 1617 days.
