This petition has been filed to modify the condition imposed on the petitioner is directed to deposit a sum of Rs.20,000/- (Rupees twenty thousand only) to the wife and children as interim maintenance until modified by the court of law to the credit of wife's account within first week of every English calender month in the above Crl.O.P.No.2545 of 2022 dated 04.02.2022.
2. The learned counsel for the petitioner submitted that the petitioner is willing to continue his marital relationship with the complainant, however, his wife and his family is not inclined to accept his proposal and they are just maintaining silence over this issue as they are getting sufficient interim maintenance. He would submit that he is only bread winner of the family and he is facing tremendous amount of hardship to pay the said amount and it has caused extreme mental pressure to the petitioner as it was a time bound condition and minor 1/4
non-compliance of the condition due to extreme financial pressure would lead to revocation of anticipatory bail. Hence, the present petition has been filed to modify the condition.
3. The learned Government Advocate (Crl. Side) would submit that he has not complied the condition and now charge sheet has been filed. He would also submit that the petitioner has to appear as and when required and strongly opposed to allow this petition.
4. Considering the facts and circumstances and also considering the reasons stated by the petitioner in the petition seems to be justifiable, this Court is inclined to modify the condition that the petitioner shall deposit a sum of Rs.12,000/- (Rupees twelve thousand only) to the wife and children as interim maintenance until modified by the court of law to the credit of wife's account within first week of every English calender month.

5. Except the above modification, the other conditions imposed by this Court in Crl.O.P. No. 2545 of 2022 vide order dated 04.02.2022 shall remain unalterted.
6. Time is extended for further period of two weeks for execution of sureties from the date of receipt of copy of this order. 17.03.2023 rpp 3/4
