Heard both sides and perused the records.

2. The learned counsel for the petitioner has submitted that he has filed surety discharge petition before the XI Metropolitan Magistrate and petition was dismissed and hence, this petition.

3. The learned Government Advocate (Crl.side) has submitted that the petitioner is none other than the wife of the first accused and she stood as a blood relative surety and after investigation in Crime No.842 of 2008, the Inspector of Police, Central Crime Branch II, Egmore, Chennai has filed no further action report and it is in the closure process.

4. After hearing both sides, it is clear the closure report proceedings are still pending. In the interest of justice, there will be a direction to the trial Magistrate to https://hcservices.ecourts.gov.in/hcservices/

complete the closure process of the Crime No.842 of 2008 at an early date, within a period of twelve weeks from the date of receipt of a copy of this order and to deal with the surety discharge application in accordance with law.

5. Accordingly, the order in Crl.M.P.No.131 of 2008 is set aside and the matter is remanded back to the Magistrate to carry out the direction as stated above.

6. With the above directions, this criminal revision petition is allowed.
