The learned counsel for appellant is directed to immediately serve the papers on the learned counsel for respondents 2 and 3. Notice to 1st respondent is dispensed with, since he remained exparte before the Tribunal.

This Civil Miscellaneous petition has been filed seeking to condone the delay of 155 days in filing the cross appeal in Civil Miscellaneous Appeal. 3.

Heard the learned counsel for the Appellant and perused the records. 4.

Having satisfied with the reasons assigned in the affidavit filed in support of this petition, the miscellaneous petition is allowed and the delay of 155 days is condoned.

Registry is directed to number the main Civil miscellaneous appeal, if it is otherwise in order and list the same for admission in due course. When the matter is posted for admission, the name of learned counsel for 2nd & 3rd respondent shall be printed in the cause-list.
