Petition filed under Article 226 of the Constitution of India to issue a Writ of Certiorarified Mandamus calling for the records of the first respondent in relation to G.O.Ms.No.150 Finance (CMPC) Department dated 20.05.2023 and quash the same and issue a consequential direction to the respondents to adopt remedial measure as given under Rule 4(3) of the Tamil Nadu Revised Pay Scale Rules 1989 and 1998 Rules, to the Tamil Nadu Revised Pay Scale Rules 2009 and to protect the higher pay of lower post of Primary School Headmasters i.e. Rs.23,940 - in respect of petitioner No.1, 2, 3, 4 and 6 and Rs.22,950/- in respect of petitioner no.5, in the scale of pay of Rs.15600 - 39100 + 5400 GP and fix the same in the scale of pay of B.Ed. Middle School Headmaster of Rs.9300 - 34800 + 4600 GP from the date of promotion as B.Ed.

This writ petition has been filed seeking issuance of Writ of Certiorarified Mandamus calling for the records of the first respondent in relation to G.O.Ms.No.150 Finance (CMPC) Department dated 20.05.2023 and quash the same and issue a consequential direction to the respondents to adopt remedial measure as given under Rule 4(3) of the Tamil Nadu Revised Pay Scale Rules 1989 and 1998 Rules, to the Tamil Nadu Revised Pay Scale Rules 2009 and to protect the higher pay of lower post of Primary School Headmasters i.e. Rs.23,940 in respect of petitioner Nos.1, 2, 3, 4 and 6 and Rs.22,950/- in respect of petitioner no.5, in the scale of pay of Rs.15600 - 39100 + 5400 GP and fix the same in the scale of pay of B.Ed. Middle School Headmaster of Rs.9300 - 34800 + 4600 GP from the date of promotion as B.Ed.

those persons who have been conferred selection grade in the lower post, if the salary drawn by them in the promoted post is either equal to or less than the salary that was drawn by them in the lower post. Hence, this Court may, without going into the merits of the case, permit the petitioners to make fresh representation to the respondents in terms of G.O.Ms.No.210, Personnel and Administrative Reforms Department, dated 11.03.1987.
3.Considering the limited relief now sought for by the learned counsel appearing for the petitioners, this Court without expressing any opinion on the merits of the case and without interfering with the order impugned in this writ petition, grant liberty to the petitioners to make fresh representation to the respondents in terms of G.O.Ms.No.210, Personnel and Administrative Reforms Department, dated 11.03.1987. If any such representation is made by the petitioners, the respondents shall consider the same in terms of G.O.Ms.No.210, Personnel and Administrative Reforms Department, dated 11.03.1987, if the said Government Order is applicable to the petitioners and if the said Government Order is not superseded by another Government Order and pass appropriate orders, as expeditiously as possible.
