Respondents Habeas Corpus Petition filed under Article 226 of the Constitution of India praying to issue a Writ of Habeas Corpus directing the respondents to produce the petitioner's daughterin-law Gayathri w/o.Sivakumar, aged about 29 years and minor Sanjanashree d/o.T.Sivakumar, aged about 9 years, before this Court and set them at liberty forthwith.

ORDER

[Order of the Court was made by P.N.PRAKASH, J] This petition has been filed seeking a direction to the respondents to produce the petitioner's daughter-in-law Gayathri w/o.Sivakumar, aged about 29 years and minor Sanjanashree d/o.T.Sivakumar, aged about 9 years, before this Court and set them at liberty forthwith.

2. It is the case of the petitioner that her son Sivakumar got married to Gayathri and through the wedlock, Gayathri has a daughter Sanjanashree, aged about 9 years now. It appears that https://hcservices.ecourts.gov.in/hcservices/

Sivakumar and Gayathri got estranged, after which, Gayathri and Sanjanashree were living in the house of the petitioner. While that being so, it is the case of the petitioner that Gayathri and Sanjanashree went missing from 02.09.2021 and that their whereabouts are not known. It is the further grievance of the petitioner that the police are not taking effective steps to secure them.

3. On instructions, learned Additional Public Prosecutor appearing for the State submitted that on the complaint given by the petitioner, a case has been registered in Tharamani P.S.Crime No.424 of 2021 on 04.09.2021 for 'woman and girl missing'.

4. In the aforestated circumstances, we direct the Assistant Commissioner of Police, Taramani, to supervise the investigation in Tharamani P.S.Crime No.424 of 2021 and keep the petitioner informed of the developments, if any. As and when the detenues are secured, they shall be produced before the XVIII Metropolitan Magistrate, Saidapet, under intimation to the petitioner. On such production, the learned Magistrate shall pass appropriate orders.

With the above direction, this Habeas Corpus Petition is closed.
