The petitioners/A1 & A2 seek anticipatory bail in Crime No.8 of 2024 registered by the respondent Police for the offences punishable under Sections 7(1) of COTPA act r/w 328 of IPC with respect to an occurrence took place on 05.01.2024.
2. The petitioners herein are running a transport business in the name of Chakrapani Vyapar Private Limited.
3. It is stated that in their transport vehicle, a Benz container lorry running from Bangalore to Salem banned tobacco products of 2,425 kgs had been transported.
4. The learned counsel for the petitioners had forwarded a copy of an invoice dated 04.01.2024 claiming that polythene was transported and that the driver had substituted the product. That is an issue which the petitioners can advance during the course of trial. As on date, the respondent had seized 2,425 kgs of banned tobacco products from the lorry which was owned by 1/3
the petitioners herein.
5. It is also contended by the respondent that the banned tobacco products are also owned by the petitioners herein.
6. Taking all those factors into consideration, I am not inclined to grant anticipatory bail to the petitioner. Accordingly, this Criminal Original Petition stands dismissed.
