ORDER
The petitioner stands convicted for major offence under Section 302 IPC and sentenced to undergo life imprisonment by the learned II Additional District Judge, Namakkal in SC.No.115/2005, has filed this petition seeking to set off the period of incarceration, which was for about 14 years.
2. The learned counsel for the petitioner submitted that the petitioner served as under trial prisoner between 27.08.1992 and 18.07.2006. The petitioner was convicted on 18.07.2006 vide the above mentioned order. Since the petitioner has been imprisoned for a period of 14 years. The petitioner has filed this petition seeking to set off the period of incarceration and treat the same as one suffered for the conviction imposed in SC.No.115/2005. The learned counsel for the petitioner has produced a copy of the order passed by the Hon'ble Apex Court in the clarification petition filed by the petitioner dated 25.11.2008 passed in Crl.M.P. Nos.18325 - 18326/2008, wherein the Hon'ble Supreme Court has dismissed the petition seeking special leave.
3. In view of the above, this petition is dismissed and liberty is granted to the petitioner to work out his remedy before the competent forum.
