ORDER : The Court Made the following order :- The petitioner, who apprehends arrest for the alleged offence under Sections 6(4) TN Scheduled Commodities (RDCS) Order, 1982 r/w Section 7(1)(a)(ii) of Essential Commodities Act, 1952 in Crime No.237 of 2021, seeks anticipatory bail.

2. The case of the prosecution is that the petitioner alleged to be found in possession of 70 bags of PDS rice each contains 50 kgs. Hence the respondent police seized all the PDS bags and registered a case against the petitioner. Hence the complaint.

3. The learned counsel appearing for the petitioner submitted that the petitioner has not committed any offence as alleged by the prosecution and he has been falsely implicated in this case. Hence, he prays for grant of anticipatory bail.

4. The learned Government Advocate (Crl.Side) submitted that 3 previous cases pending against the petitioner and already in Crl.O.P.No.15718 of 2021 bail granted with condition, but the petitioner not complied the earlier condition. Hence, he vehemently opposed to grant anticipatory bail to the petitioner.

5. Considering the facts and circumstances of this case, the earlier condition not complied by the petitioner, this Court is not inclined to grant anticipatory bail to the petitioner.
