ORDER

The petitioner apprehends arrest at the hands of the respondent police for the offence punishable under Sections 318(4) of the BNS 2023 in connection with Crime No. 209 of 2025, seeks anticipatory bail.

2. The allegation against the petitioner is that the petitioner is arrayed as A3 in this case. Petitioner in collusion with the other accused, induced several persons to join the chit, collected huge sums of money and cheated them to the tune of Rs.2,60,66,867/-. Hence, the case has been registered.

3.The learned counsel for the petitioner submitted that this Court had earlier dismissed the anticipatory bail petition filed by the petitioner on two occasions. He further submitted that the co-accused, namely A1 and A2, have already been granted bail. Since, there is a change in circumstances, and the petitioner is a lady aged about 65 years, he prayed for grant of anticipatory bail.

The learned Government Advocate (Crl.Side) appearing for the respondent police submitted that several witnesses have stated against her that she has petitioner approached them and induced them to join the chit. It is further submitted that the accused have cheated 60 members to the tune of Rs.2,60,66,867/-. Therefore, she vehemently opposed the grant of anticipatory bail to the petitioner.

5. Considering the facts and circumstances of the case, the huge amount involved in the offence which is yet to be recovered, and considering the overt act attributed to the petitioner and investigation is pending, I am not inclined to grant the anticipatory bail to the petitioner.

6. Accordingly, this Criminal Original Petition stands dismissed.
