Prayer:- Writ Petition is filed under Article 226 of the Constitution of India, praying to issue a Writ of Mandamus directing the respondent to reinstate the petitioner back in service with all consequential benefits.

ORDER

This writ petition has been filed by the petitioner seeking a direction to the respondent to reinstate the petitioner back in service with all consequential benefits.

2. According to the writ petitioner, while she was working as Daily rated employee in the respondent/Corporation since 2004, continued to be as DLR till her termination from April, 2013 which is based on a criminal case registered against her. It is the case of the petitioner that a case was registered in Crime No.5 of 1993 under Section 420 of IPC by the Vigilance and Anti Corruption Unit of the Police Department of Pondicherry. Subsequently, she was arrested and remanded to judicial custody on 07.04.1993. Thereafter, she was deemed to be under suspension under Rule 10(2) (a) of the CCA Rules. But, she was not involved in the aforesaid criminal case and no charge sheet was filed against her till now. Hence, she made several representations to the respondent/Corporation requesting for re-instatement in service, but there is no reply from the respondent/Corporation in this regard sofar. Hence, the writ petitioner has come forward with the present writ petition.

3. No counter affidavit has been filed by the respondent/Corporation in this case.

4. Without going into the merits of the matter, this Court directs the respondent/Corporation to consider the petitioner's representation 21.05.2014 and pass appropriate orders on merits and in accordance with law, as expeditiously as possible within a period of twelve weeks (12) from the date of receipt of a copy of this order. It is needless to say that the petitioner shall also furnish a copy of the representation along with the order copy to the respondent/Corporation.

5. With the aforesaid direction, the writ petition is disposed of. No costs.
