ORDER

(The case has been heard through video conference) The petitioners, who were arrested and remanded to judicial custody on 09.12.2020 for the offence punishable under Sections 363(A) of I.P.. @ U/Sec. 120B, 109, 114, 365, 370 of I.P.C. and U/Sec.87r/81 of JJ Act, in Crime No.1097 of 2020, seeks bail.

2. This is the second bail petition and the earlier petition was dismissed on 18.01.2021. The allegation is that all the petitioners have forcibly abducted a baby, 3 1⁄2 year old, belongs to the defacto complainant from the parents for the purpose of selling her to a third party. The person, to whom, they have approached to sell the baby, they have refused to receive the baby, hence, they have left the child in street. Accordingly, based on the complaint given by the parents of the baby, a criminal case was registered against the petitioners and they were arrested and remanded to judicial custody.

3. Taking into consideration of the fact that as it is a heinous crime, the petitioners have stolen the child from the https://hcservices.ecourts.gov.in/hcservices/

parents for the purpose of selling, and the investigation is still pending, this Court is not inclined to grant bail to the petitioner.
