Judges Summons had been taken out for returning the documents i.e., Exhibits R1 to R33 which had been filed during the trial of E.P.No.8 of 2001.

2. E.P.No.8 of 2001 had been contested with respect to the election conducted for No.10 Embalam (S.C.) Legislative Assembly constituency of Union Territory of Puducherry on 10.05.2001. By an order dated 09.08.2002, the Election petition was dismissed. The applicant was the second respondent in the Election petition. During trial, he has marked the original documents as Exs.R1 to R33 and now he seeks return of the original documents. To express bonafide, he has filed all the certified copies.

3. In view of these facts, the Judges Summon is allowed. Registry is directed to return the Exs.R1 to R33 marked during the trial in E.P.No.8 of 2001 to the present applicant N.Gangadharan, who was the second respondent in the Election Petition, on proper identification and acknowledgement and retain the certified copies in the record. http://www.judis.nic.in 1/2
