ORDER
This Petition has been filed seeking to set aside dismissal order in Crl.M.P.No.233 of 2025, dated 07.01.2025 by the Learned Principal Sessions Judge at Chennai and consequently may be pleased to modify the bail condition "petitioner / Accused is ordered to be released on bail on executing a bond for a sum of Rs.10,000/- with two sureties each, out of which one surety must be close relative" imposed by Learned XI Metropolitan Magistrate, Saidapet at Chennai in Crl.M.P.No.21196 of 2024, dated 12.11.2024 connection with Cr.No.50 of 2024 (On the file of the Respondent Police).
2. Learned counsel for the petitioner would submit that the petitioner was arrested in Crime No.50 of 2024 for the offences punishable under Section 79 BNS and Section 66C & 66D of IT (Amendment) Act 2008. He further submitted that he was granted bail by the learned XI Metropolitan Magistrate, Saidapet at Chennai in https://www.mhc.tn.gov.in/judis

rna Crl.M.P.No.21196 of 2024 dated 12.11.2024 with the condition that the petitioner is ordered to be released on bail on executing a bond for a sum of Rs.10,000/- with two sureties each, out of which one surety must be close relative. He further submitted that the petitioner is from Andhra Pradesh and he has no relatives in Tamil Nadu and thereby the petitioner had filed an application seeking for modification for condition in Crl.M.P.No.233 of 2025 before the Principal Sessions Judge, Chennai and the learned Judge shall pleased to dismiss the same and thereby the petitioner has brought to this Court. Learned counsel would submit that the close friends of the petitioner in Tamil Nadu are ready to stand surety with him and thereby he has ready to modification.
3. Taking into consideration the submission made by the learned counsel appearing for the petitioner, this Court is inclined to modify condition 4 in the order dated 12.11.2024 in Crl.M.P.No.21196 of 2024 (On the file of the XI Metropolitan Magistrate, Saidapet) as, "7. .....In the result, the petitioner/accused is ordered to be released on bail on executing a bond for a sum of Rs.10,000/- with two sureties, each for a like sum to the satisfaction of the learned XI Metropolitan Magistrate, Saidapet, Chennai."
It is made clear that all other conditions remain unaltered.
4. With the above direction, this Criminal Miscellaneous Petition stands ordered.
