O R D E R

The petitioners, who apprehends arrest at the hands of the respondent police for the offences punishable under Section 303(2), 326(a) of BNS Act, 2023, and r/w 21(1) Mines and Minerals (Development and Regulation) Act, 1957, in Crime No.431 of 2025 on the file of the respondent Police, 1/4

seek anticipatory bail.

The allegation against these petitioners is that, the petitioners joined hands with the other accused and involved in illegal quarrying and transportation of one unit of Norambu sand using tipper lorries and hence, this case.

The learned counsel appearing for the petitioners submitted that the petitioners have been falsely implicated in this case and have not involved in the offence as alleged; and are ready to co-operate with the investigation and also ready to abide by any conditions that may be imposed by this Court, hence sought for anticipatory bail to the petitioners. 4.

The learned Government Advocate (Crl. Side) appearing for the respondent while opposing the anticipatory bail to the petitioners reiterated the prosecution case and submitted that the petitioners along with the co-accused illegally transported the one unit of Norambu sand using tipper lorries.

Considering the submissions made on both sides and perused the materials available on record.

Considering the facts and circumstances of this case, gravity of offence, nature and quantity involved in this case and that it is the case of illegal sand quarrying and also caused damage to the ecosystem. Therefore, this Court is not inclined to grant anticipatory bail to the petitioners. 7.
