This petition is filed to condone the delay of 40 days in filing the above appeal.

2.The petitioner as complainant had filed a private complaint under Section 138 of the Negotiable Instruments Act against the respondents in C.C.No.38 of 2019, which was dismissed by the trial Court, against which, he preferred a leave petition and appeal.

3.The petitioner had taken private notice to the respondents, which was returned. The tracking report shows that notices have been delivered to the addressees but the returned postal covers are with an endorsement as 'Addressee left'. In view of the same this Court finds that notices have been taken to the given address of the respondents. Hence, it is to be construed as service of notice.

4.In view of the same, the delay stands condoned and the petition is ordered.
