Prayer: Petition filed under Article 226 of the Constitution of India seeking a writ of mandamus, directing the second respondent to consider the petitioner's representation dated 15.06.2023 to conduct a proper enquiry and to issue the free house site patta to the eligible beneficiaries only for the lands encompass in survey no.16/2 situated in Periyanoor Village, Palacode Taluk, Dharmapuri District on merits. ORDER
(Made by the Hon'ble Chief Justice) Heard Ms.E.Udayasankari, learned counsel for the petitioner and Mr.C.Kathiravan, learned Special Government Pleader for the respondents.
2. Learned counsel for the petitioner submits that directions be given to the second respondent to conduct an enquiry and to issue free house site pattas to eligible beneficiaries for the lands encompassed in Survey No.16/2 situated in Periyanoor Village, Palacode Taluk, Dharmapuri District.
3. The petitioner has given a representation and it is stated that non-deserving persons have been selected for issuance of free house site pattas.
4. Learned Special Government Pleader submits that after proper enquiry, free house site pattas are issued to 169 beneficiaries.
5. The present petition does not give the details of the persons who are eligible and entitled for free house site pattas and are deprived of the same. In absence of the same, no specific orders can be passed.
6. In case the petitioner is in a position to demonstrate that there are eligible persons, who are deprived of the free house site pattas, then the petitioner may give the details to the Government Authorities, which would be considered by the Government Authorities on its own merits.
7. The writ petition, as such, stands disposed of with the aforesaid observations. There shall be no order as to costs. (S.V.G., CJ.) (D.B.C., J.) 05.02.2024 Index :
