Writ Petition is filed under Article 226 of the Constitution of India to issue a writ of mandamus directing the respondents 1 to 4 to conduct a detail enquiry against the respondents 5 to 7 to take appropriate action including removing the 5th respondent from the post of Athipattu Village Panchayat President, Athipattu, Cuddalore District by disposing the petitioner written representation dated 14.12.2023. ORDER

The petitioner has filed this writ petition seeking action against the sixth and seventh respondents in view of the representation given by him to the second respondent.

2. The petitioner is said to be the former President of the Athipattu Village Panchayat, Cuddalore. The various allegation stated against the sixth and seventh respondents is to the effect that they have misappropriated the funds of the Athipattu Village Panchayat.

3. Mr.G.Pugazhenthi, the learned counsel for the respondent 6 and 7. submitted that the petitioner had also misappropriated a huge sum belongs to the said Panchayat.

4. Since both the parties are making counter allegations, it is up to them to initiate criminal action against each other. Even if a complaint is given to the second respondent, the second respondent can inquire only with the aid of police.

5. With the above observations, this Writ Petition is disposed. No costs.
