ORDER

This Criminal Original Petition has been filed to direct the respondent Police to investigate and file final report against the accused Santhose in FIR No.693 of 2016, dated 23.09.2016.

2.The petitioner, who is the mother of the victim girl lodged a complaint to the respondent Police that her minor daughter was kidnapped. The respondent Police registered a case in Crime No.693 of 2016 on 23.09.2016. Since the respondent Police did not take any action, the above petition is filed.

3.The learned Additional Public Prosecutor appearing for the respondent submitted that the petitioner has filed H.C.P.No.2077 of 2016 to secure her minor daughter. He further submitted that the daughter of the petitioner was produced before this Court on 24.10.2016 and she stated that she was not kidnapped by anyone and on her own, she had gone to her Aunt Aruljothi. by order dated 21.11.2016, closed the Habeas Corpus Petition. Thereafter, the respondent Police on completion of investigation referred the matter as Mistake of Fact and served RCS notice to the petitioner on 22.11.2016. 4.In view of the FIR in Crime No.693 of 2016 closed as Mistake of Fact and RCS notice has been served to the petitioner, nothing survives in this petition and the same is, accordingly, dismissed.
