PRAYER: Writ Petition filed under Article 226 of the Constitution of India to issue a Writ of Certiorari to call for the records in pursuant to the impugned seniority list passed by the 1st respondent in proceedings Na.Ka.87377/2001/Pa.tho.2, dated 06.11.2002 and quash the same insofar as all the petitioners are concerned and place the name of all the petitioners above the respondents 3 and 4 in the appropriate place.

By consent of both the parties, the present writ petition is taken up for final disposal.

2. The prayer in the present writ petition challenging the seniority list of the year 2002 cannot be considered at this point of time. If at all the petitioners are of the view that their names require to be retrospectively promoted to the higher post, it would always be open to them to ventilate their grievance before the first respondent and this Court would not be justified in considering the prayer for quashing the seniority list of the year 2002.

3. With this observation, the petitioners are hereby granted liberty to make a fresh representation to the first respondent herein ventilating their grievance and on receipt of the same, the first respondent herein shall consider it on its own merits and take appropriate course of action in accordance with law as expeditiously as possible, in any event, within a period of 3 months from the date of receipt of the representation.

4. The writ petition stands disposed of accordingly. No costs.
