ORDER

The petitioner, who apprehends arrest at the hands of the respondent police for the offence under Section 303(2) & 326(a) of B.N.S & 2(1) of the Mines and Minerals (Development and Regulation) Act, 1957 in Crime No.7 of 2026, on the file of the respondent police, seeks anticipatory bail.

2. The allegation against the petitioner is that the petitioner joined hands with other accused illegally quarried the sand from Bagavathy hills 1/4

(Bagavathy malai adi vaaram) by using Tipper lorry and JCB. The accused were intercepted by the police officials however the petitioner herein was escaped from the scene of occurrence. Hence a case has been registered.

3. The learned counsel for the petitioner submitted that the petitioner is innocent and he has not committed any offence as alleged by the defacto complainant. He further submitted that it is only a rough sand and that the petitioner is not present at the scene of occurrence and he has been falsely implicated in this case. He further submitted that he is ready to abide by any conditions that may be imposed by this Court and ready to co-operate with the investigation. Hence, he prays to grant anticipatory bail to the petitioners.

The learned Government Advocate (Crl.Side) appearing for the respondent reiterated the prosecution case and, upon instructions, submitted that totally four accused were cited but at the time of place of occurrence, two persons were arrested and that the petitioner is ranked as A4. The learned counsel further submitted that the petitioner is not actively participated in the scene of occurrence and that the investigation in this case is still pending and also no previous bad antecedents have been registered against him. However, she opposed to grant anticipatory bail to the petitioner. 2/4

Considering the fact the petitioner joining hands with other accused involved in illegally quarrying the hill sand from the base of hills by using a Tipper lorry and earth mover, this Court is of the view that if the petitioner is granted anticipatory bail, there is a likelihood that he would indulge in similar kind of offences. Hence, this Court is not inclined to grant anticipatory bail to the petitioner.
