CMP.Nos.9072 to 9077 of 2018 & 5485 to 5486 of 2018 in S.A.No.797 of 2006 ABDUL QUDDHOSE, J.

These civil miscellaneous petitions have been filed (a) to condone the delay of 328 days in filing a petition to set aside the abatement caused due to the death of the sole Appellant, (b) to set aside the abatement cause due to the death of the sole Appellant, (c) to bring on record the legal representatives of the deceased sole Appellant, (d) to condone the delay of 873 days in filing a petition to set aside the abatement caused due to the death of the first respondent, (e) to set aside the abatement cause due to the death of the first respondent, (f) to bring on record the legal representatives of the deceased first respondent, (g) to condone the delay of 1013 days in filing a petition to set aside the abatement caused due to the death of the second respondent, (h) to set aside the abatement cause due to the death of the second respondent and (i) to bring on record the legal representatives of the deceased second respondent, in the main second appeal.

2. Learned counsel for the respondents has also not raised any serious objection for allowing these petitions.

3. This Court has also satisfied with the reasons stated in the affidavit filed in support of these petitions. Accordingly, these civil miscellaneous petitions are allowed as prayed for.

4. Registry is directed to carry out the necessary amendments in the cause

title and list the second appeal for hearing on 09.09.2021.

5. In the meanwhile, learned counsel for the Appellants is directed to serve copies of papers on the respondents counsel forthwith. 10.08.2021 nl ABDUL QUDDHOSE, J.
