Prayer: Writ Petition is filed under Article 226 of the Constitution of India, to issue a Writ of Mandamus, directing the respondents 1 & 2 herein to consider the petitioner's representation dated 24.02.2020 and conduct an enquiry against the 4th respondent and to cancel the Settlement Deed dated 12.03.2009 registered as Document no.1409/2009 at SRO, Ambattur.

ORDER

The petitioner has moved this Writ Petition seeking a direction to the respondents 1 & 2 for cancelling the Settlement Deed dated 12.03.2009 which was registered as Document no.1409/2009 at SRO, Ambattur and to conduct an enquiry against the 4th respondent, by considering the petitioner's representation dated 24.02.2020.

2. The petitioner is a senior citizen, who has moved the District Collector, the first respondent herein with his representation dated 24.02.2020 for cancelling the Settlement Deed dated 12.03.2009 under the Maintenance and Welfare of Parents and Senior Citizens Act, 2017. Since no action is forthcoming, the petitioner is before this Court.

3. Mr.G.Rajesh, learned Government Advocate takes notice for the respondents 1 & 2 and Mr.T.M.Pappiah, the learned Special Government 2/5

Pleader takes notice for the third respondent.

4. Mr.G.Rajesh, learned Government Advocate has made a statement on instructions, that the said representation is now pending before the RDO, the second respondent herein, who is now holding an enquiry on 16.02.2021 at 11.30 a.m at the office of the second respondent.

The said statement of the learned Government Advocate is recorded. 6.Since the enquiry is already fixed, no further direction is required to be made except that the second respondent is directed to issue notice to all the parties who are likely to be affected by his decision and after providing the parties a fair and effective hearing, to dispose of the matter through a speaking order within a period of twelve (12) weeks from the date of receipt of a copy of this order.
