Second Appeal has been filed against the judgment and decree passed in A.S.No.15 of 2007, dated 31.01.2008, on the file of the Principal District Court, Cuddalore, in confirming the judgment and decree passed in O.S. No.16 of 2002, dated 05.04.2005, on the file of the Sub Court, Panruti.

2.When the matter was called on 13.06.2024, the learned counsel for the appellant was not ready and the matter was ordered to be listed on 25.06.2024. Even on 25.06.2024, the learned counsel for the appellant was not ready. Hence, once again the matter was ordered to be listed on 26.06.2024. On 26.06.2024, when the matter was called, the learned counsel for the appellant reports no instruction from his client and hence, Registry was directed to print the name of the appellant and the matter was adjourned to 05.07.2024 and on that date, no representation for the appellant and, the matter was listed to-day i.e., on 18.07.2024.

on behalf of the appellant. Hence, this Second Appeal is dismissed for 'non prosecution'. No costs. Consequently, connected miscellaneous petitions, if any, are also closed.
