ORDER

This Writ Petition is filed seeking to issue a Writ of Mandamus directing the 1st respondent herein to pass an order in respect of the appeal filed by the petitioner dated 01.10.2022 for transfer of Patta pending on the file of the 1st respondent.

The learned counsel for the petitioner submitted that on 15.08.2022, the petitioner made an application before the 2nd respondent for transfer of Patta in his name of the petitioner as per the directions of this Court in W.P.No.14725 of 2022 dated 17.06.2022. But the same was rejected by the 2nd respondent by proceedings dated 19.09.2022 against which, the petitioner filed an appeal on 01.10.2022. However, the same is still pending. Hence, the present Writ Petition is filed.

3. Mr.T.Arunkumar, learned Additional Government Pleader takes notice for the respondents.

4. Having regard to the facts of the case and since the Writ Petition is filed seeking a simple writ of mandamus to pass an order in respect of the appeal filed by the petitioner dated 01.10.2022, without going into the merits of the case, this Court directs the 1st respondent to issue notice of hearing on the appeal to the petitioner and to the respondent/s in the appeal, rival 2/5

claimants/objectors if any as the case may be, if already not issued and after issuing notice and giving opportunity of hearing to all the parties, pass orders on merits and in accordance with law if already order not passed, within a period of two months from the date of receipt of a copy of this order.

5. With the above directions, the Writ Petition is disposed of at the admission stage itself. No costs.
