Prayer: Writ Petition filed under Article 226 of the Constitution of India, seeking for a Writ of Certiorarified Mandamus after calling for the records pertaining to the order in Note No.68422/A2/SETCTN/2006 dated 8.4.2007 of the 1st respondent and the seniority list dated 9.4.2007 issued by the 2nd respondent quash the same insofar as fixing his seniority and placing the petitioner as juniors to the respondents 3 to 7 and consequently fix his seniority in the cadre of Superintendent, Senior Superintendent and Section Officer above the respondents 3 to 7 and to consider and grant promotion to the petitioner to the post of Assistant Manager in the existing vacancies as on date based on such seniority.

When the matter is taken up for hearing the learned Standing Counsel appearing for the respondents 1 and 2 would submit that the petitioner died on 18.02.2011. Thereafter, no substitution petition has been filed to bring the legal heirs of the deceased petitioner on record. Further, the petitioner's wife also died on 10.04.2015. Hence, nothing survives for adjudication in this writ petition.

2. Recording the submissions made by the learned Standing Counsel, this writ petition is dismissed as having become infructuous. No costs. Consequently, connected miscellaneous petition is closed.
