Respondents Prayer: Petition filed under Article 226 of the Constitution of India seeking a writ of mandamus, directing the Respondents 1 to 5 to demolish and remove the entire illegal and unauthorised construction put up by the Respondents 6 to 9 in old survey No 58/1, New Survey No 98/13 in Ellaiamman Kovil Street, Neelangarai Village, Sholinganallur Taluk, Chennai 600 115 and further direct the Respondents to retrieve the public street in survey No 98/12, Neelangarai Village, Sholinganallur Taluk, Chennai District, by removing the encroachments made by the Respondents 6 to 9 by considering the petitioners representation dated 07.09.2023. ORDER

(Made by the Hon'ble Chief Justice) Heard Mr.S.A.Sayed Shuhaibb, learned counsel for the petitioner, Mr.V.Sudalai Selvan, learned counsel for respondent 1, Mr.A.Arun Babu, learned counsel for respondents 2 and 3 and Mr.T.K.Saravanan, learned Government Advocate for respondents 4 and 5.

2. Learned counsel for respondents 2 and 3 submits that survey would be conducted and if encroachment is found, action for removal of the encroachment would be undertaken on the public street bearing S.No.98/12. The said action shall be initiated within a period of two months.

3. In light of the above, the writ petition stands disposed of. There shall be no order as to costs.
